What Is the Mid America Pet Food Lawsuit About?

Mid America Pet Food, LLC has agreed to a $5.5 million class action settlement over recalled pet food products allegedly contaminated with Salmonella. If you purchased affected pet food between September 3 and November 9, 2023, or your pet suffered illness or death after consuming these products, you may be eligible for compensation. Act now — claims must be submitted by February 5, 2026.

 

The settlement resolves claims that Mid America Pet Food sold contaminated dog and cat food products, which may have caused illness or death in pets and potentially caused illness in humans who handled the food. The lawsuit alleges that Mid America Pet Food marketed and sold products under brands including Victor Super Premium, Wayne Feeds, Eagle Mountain, and Member’s Mark that were later recalled due to potential Salmonella contamination.

 

While Mid America Pet Food denies any wrongdoing, the company agreed to the settlement to avoid further litigation. The settlement covers U.S. consumers who purchased affected products during the recall period and provides financial compensation for documented pet injuries, breeder losses, and food purchases.

Who Qualifies for the Settlement?

You may be eligible if you:

  • Reside in the United States, and
  • Purchased one or more covered Mid America Pet Food products between September 3 and November 9, 2023, as part of the recalls announced on September 3, October 30, and November 9, 2023, or
  • Experienced a pet injury or death due to these products.

 

Excluded from the Settlement Class:

  • Purchasers for resale
  • Individuals who previously settled directly with Mid America Pet Food
  • Officers, directors of Mid America Pet Food, and court staff
  • Anyone who validly opts out of the settlement

 

What Pet Food Products Are Covered?

The settlement covers specific recalled products from these brands:

  • Victor Super Premium
  • Wayne Feeds
  • Eagle Mountain
  • Member’s Mark

 

Products must have "Best By" dates before October 31, 2024. A full list of covered products is available on the official settlement website.

 

What Compensation Is Available?

Settlement benefits are paid from the $5.5 million fund according to the type of claim.

 

1. Pet Injury Claims

  • Documented Pet Injury Claims: Up to $100,000 per claim with veterinary records, invoices, or proof of expenses, including future care related to the exposure.
  • Undocumented Pet Injury Claims: $50 for illness or $100 if the pet died, supported by a credible declaration.
  • Breeder Claims: Up to $100,000 per claim for documented business-related pet injury losses.

 

2. Consumer Food Purchase Claims

  • Documented Purchases: Reimbursement of the purchase price with receipts, invoices, or proof of payment.
  • Undocumented Purchases: $20 per bag (up to 2 bags, max $40).

 

3. Pro Rata Adjustments

If the settlement fund has remaining money after all approved claims, payments may be increased proportionally. Conversely, if funds are insufficient, payments will likely be reduced on a pro rata basis.

How to Submit Your Claim

To receive payment, submit a Claim Form either:

  • Online: Visit the official settlement website claim page.
  • Mail: Send a completed paper Claim Form to the Settlement Administrator.

 

Important: Include all required documentation for maximum payout. Ensure forms are fully completed, signed, and submitted by February 5, 2026. Late claims may not be accepted.

 

What Happens Next? 

After submitting your claim:

  1. The Court must grant final approval of the settlement at or after the Final Approval Hearing on February 6, 2026.
  2. Any appeals are resolved.
  3. Claims are reviewed and processed in accordance with the Plan of Allocation.
  4. Approved claimants will be notified of their payment amount.

 

Payments will be issued after all steps are complete.
