About the Evenflo “Big Kid” Booster Seat Class Action Lawsuit
In early 2022, Evenflo was sued by a plaintiff who alleged that the child product company made misleading claims about its Big Kid Belt-Positioning Booster Seat. The class action lawsuit accused the company of marketing the popular car seat as side-impact tested and safe for kids at least one year old or 30 pounds.
The problem? The booster seat didn’t actually perform to these standards, meaning children who relied on it may have been put in harm’s way. More than 18 million families purchased the seat, believing they could depend on Evenflo for safe and reliable products. For many of them, the company’s misleading claims were a deep act of betrayal. Worse still, the lawsuit claims, is that kids were seriously harmed by Evenflo’s misrepresentation.
“Very young passengers using the ‘Big Kid’ booster seats, which did not incorporate a five-point harness as part of the booster seat, were traumatically injured,” states the class action complaint. A five-point harness is a safety measure that Evenflo’s internal communications even recognized as crucial.
Evenflo’s Response
Despite the backlash, Evenflo maintains that it committed no wrongdoing. However, the infant product manufacturer has agreed to a $3.5 million settlement.
Individuals who purchased an Evenflo “Big Kid” booster seat may qualify and could receive an equal portion of the settlement as a cash payment, plus a $25 credit to be used at www.evenflo.com. Up to two booster seats per person can be claimed.
Evenflo has also agreed to other terms as a result of the settlement, including that it will:
- Provide information about the safe use of its Big Kid Belt-Positioning Booster Seat (including an updated minimum weight requirement) and accurate side-impact testing data;
- Ensure marketing materials for the booster seat’s weight requirements are in line with federal regulations; and
- Provide an educational video on the safe transition from front-facing harnessed car seats to booster seats.

Who Is Eligible for the Evenflo Booster Seat Settlement?
If your child used an Evenflo “Big Kid” booster seat, you may be wondering if you qualify for part of the $3.5 million settlement. Along with other important information (such as how to opt out of the settlement), the official “Big Kid” Booster settlement page lists the following as requirements:
- You must be a person in the United States (including the District of Columbia and any U.S. territories); and
- You must have purchased one or more Evenflo “Big Kid” booster seats in the United States between January 1, 2008, and December 31, 2022.
Individuals can claim up to two Evenflo “Big Kid” booster seats and must submit proof of purchase. But don’t worry if you no longer have your receipt—any of the following can serve as proof of purchase and qualify you to make a claim:
- A receipt, invoice, credit card statement, or other documentation showing the purchase; or
- Your own documentation of the purchase (to include the city, state, and date of purchase; name of retailer; and the color/pattern of the booster seat); or
- A photograph taken in or around your car or home showing the booster seat or the seat’s packaging and documentation of the city, state, and year of purchase.
How Do Eligible Consumers Submit a Claim?
The easiest and fastest way to submit a claim for a share of the $3.5 million Evenflo “Big Kid” booster seat settlement is by using the official online claim form. Families can also submit a claim by mail to the address listed on the settlement page.
Keep in mind that all claims must be received by November 24, 2025. That means consumers must submit their claims online or ensure they are delivered to the Settlement Administrator before this deadline.
Note that some individuals may have received an Email Notice or Postcard identifying them as a class member. Those people were assigned a Unique ID number, which can be entered on the online form to streamline the claim process. However, those who did not receive a Unique ID are still able to make a claim.
What Information Is Needed To Submit A Claim?
To claim a share of the settlement and complete the claim form, Evenflo consumers must provide information including:
- Full name

- Email address

- Proof of a qualifying purchase of one or two Evenflo “Big Kid” booster seats

How Much Can Claimants Receive?
The gross (or total) settlement amount for the Evenflo “Big Kid” Booster Seat class action lawsuit is $3.5 million. Evenflo has agreed to pay up to this amount, which includes attorneys’ fees, administrative expenses, and all valid claims.
Qualifying settlement class members can claim up to two Evenflo “Big Kid” booster seats. For each valid claim, claimants can receive:
- A pro rata (proportionate share) cash payment of the net settlement fund; and
- A $25 credit that can be used for the future purchase of products on the Evenflo website
A Final Approval Hearing is scheduled for February 25, 2026, at which time the Court will decide if the settlement is fair for all parties. If the settlement is approved, claimants should receive their portion of the settlement sometime following this date.
