Parties have established fresh pretrial deadlines leading to a pivotal December 18, 2025, hearing to determine which expert witnesses will testify in upcoming hernia mesh trials. The judge will rule on which experts can formally present opinions linking product defects to patient injuries. This hearing sets the stage for 2026 bellwether trials and influences potential settlement values. Patients who experienced complications from hernia mesh implants are encouraged to consult with an attorney, as they may still qualify to file a claim and seek compensation.

Hernia Mesh Lawsuit Set for Trial Amid Ongoing Federal MDL

A hernia mesh lawsuit filed by Larry Patterson is scheduled for trial on July 13, 2026, unless a settlement is reached with Covidien beforehand. Patterson is among thousands of patients who reported injuries following hernia mesh implantation. His claim is part of a federal multidistrict litigation (MDL) consolidating similar cases for coordinated proceedings. Additional patients who suffered complications and believe they may qualify for compensation remain eligible to file individual claims and participate in the ongoing litigation against the manufacturers.

Covidien Hernia Mesh Litigation Advances with Key Hearing on Expert Testimony

Hundreds of patients are seeking settlements from Covidien, alleging its hernia mesh caused severe complications such as infections and device migration. The plaintiffs contend the manufacturer failed to provide adequate warnings about these risks. The litigation is progressing, as parties have submitted a proposed agenda for an upcoming pretrial hearing. This hearing will address the critical issue of which expert testimony will be admissible at trial, with a judicial decision expected soon. Affected patients may still be eligible to join the ongoing federal multidistrict litigation.

About Hernia Mesh Lawsuits

Hernia mesh implants were marketed as a long-term solution to reinforce weak tissue and reduce hernia recurrence. For many patients, however, the mesh has done the opposite, causing severe pain, infections, and the need for additional surgeries instead of relief.

In recent years, thousands of patients have filed hernia mesh lawsuits claiming that defective mesh products led to serious complications, long recovery periods, and permanent injury. These lawsuits allege that manufacturers failed to properly test their products, downplayed known risks, and did not adequately warn patients or surgeons about potential side effects.

How Hernia Mesh Implants Work and Why They Can Fail

Hernia mesh is a surgical mesh implant used to repair hernias by acting as a patch or reinforcement over the weakened area. It’s commonly made from synthetic materials such as polypropylene or a combination of synthetic and biologic materials.

While mesh can reduce recurrence for some patients, it can also lead to serious device-related complications, particularly when the product is defective or not suited to the patient’s condition. According to the U.S. Food and Drug Administration (FDA), reported adverse events include:

  • Chronic pain and inflammation
  • Infection and abscess formation
  • Mesh migration or shrinkage (contraction)
  • Adhesions (mesh sticking to organs or tissue)
  • Bowel perforation and intestinal obstruction
  • Hernia recurrence

Many of these complications require revision surgery and sometimes multiple surgeries to remove or replace the mesh and repair internal damage.

Common Hernia Mesh Complications

If you had hernia mesh surgery and later developed any of the following issues, you may be experiencing a mesh-related complication:

  • Persistent or worsening abdominal pain
  • Infection at or below the incision site
  • Adhesions or scar tissue that sticks organs together
  • Bowel perforation or injury to the intestines
  • Intestinal blockage or obstruction
  • Hernia recurrence after initial repair
  • Mesh migration (mesh shifting from where it was placed)
  • Mesh contraction or “balled up / wadded up” mesh
  • Fistulas (abnormal tunnels between organs or skin)
  • Open draining wounds that do not heal
  • Surgery to remove the mesh
  • In the most tragic cases, death related to mesh complications

These are many of the same injuries being reported in ongoing hernia mesh lawsuits and multidistrict litigation (MDL) across the United States.

Who Can Join The Hernia Mesh Lawsuit?

You may be eligible to join the hernia mesh lawsuit if:

  • You had hernia repair surgery with mesh.
  • You later experienced mesh-related complications such as chronic pain, infection, bowel issues, or hernia recurrence.
  • You can provide medical records documenting your complications and the type of mesh used to repair your hernia.

You may also qualify if you have suffered one or more of the following injuries after a hernia mesh implant:

  • Abdominal Pain
  • Adhesions
  • Bowel Perforation
  • Edge of Mesh Curled Towards Bowel
  • Infection
  • Hernia Recurrence
  • Intestinal Blockage
  • Mesh Migration
  • Intestinal Fistula
  • Surgery to Remove The Mesh
  • Death Due to The Mesh
  • Open Draining Would
  • The Mesh Plastic Ring is Broken
  • The Mesh Balled Up/Wadded Up

Note: The claimant must have had hernia implant surgery between January 2010 and to current date to be eligible. Eligibility can vary by state, statute of limitations, and individual medical history.

If you meet the above requirements, you may be entitled to compensation. We encourage you to seek legal advice to determine your eligibility. Various factors impact eligibility, and all cases are unique.

Which Companies Are Involved in the Hernia Mesh Lawsuits?

Currently, several medical device manufacturers are facing lawsuits over defective hernia mesh products. The companies have been accused of producing and selling mesh implants that were not properly tested for safety and effectiveness before being marketed and used. Despite knowing the risks, the companies continued to market these products to surgeons and patients.

As more evidence surfaces about the health implications of hernia meshes, the number of cases against these companies will probably grow substantially. Have you been impacted by a hernia mesh implant?  If so, you might have a case.

What Compensation Can You Expect in a Hernia Mesh Lawsuit?

The compensation you might receive in a hernia mesh lawsuit depends on a variety of components, such as:

  • The severity of your  health complications
  • The need for additional surgeries or treatments following hernia mesh surgery
  • The impact the hernia mesh has had on your quality of life.

Hernia mesh lawsuits are ongoing.  Currently, some settlements have been reached, but many cases are still being fought in court. Depending on your particular situation, the compensation for a hernia mesh implant could prove substantial, especially if you’ve suffered significant problems.

If you believe your hernia mesh implant has caused you harm and negatively impacted your health, it’s important to act quickly. Contact us today to learn more about your legal options and whether you may qualify to join the hernia mesh lawsuit.

Frequently Asked Questions (FAQ)

The specific requirements listed in the class definition govern who can join a class action lawsuit. These requirements are frequently connected to using a product, working for a specific company, or being exposed to a specific environmental factor for a predetermined amount of time.

Members of a class action lawsuit usually have no obligations if the lawsuit is unsuccessful. Because of the contingency fee agreement, lawyers only get compensated when they prevail. Nonetheless, members of the class generally forfeit their ability to file separately for the same claim if the class action lawsuit is unsuccessful.
