What’s the Class Action About?

The Tuna End Purchaser Class Action revolves around allegations that several major tuna companies colluded to fix prices, effectively overcharging consumers for canned and packaged tuna products. 

 

This lawsuit targeted some of the largest names in the industry, including brands like StarKist, Bumble Bee, and Chicken of the Sea. Plaintiffs claim these companies collaborated in unlawful agreements which artificially inflated the price of tuna products sold in stores across the United States.

 

These allegations resulted in lengthy legal proceedings, where the companies involved either settled the claims or were found guilty of participating in anti-competitive practices.  

 

The settlement funds of $152.2 million are now ready to compensate eligible consumers affected by the price-fixing scheme. It is a huge win for consumers, as the class action holds these corporations accountable and will reimburse consumers who overpaid for tuna products.

Who Qualifies and How Much Can You Claim?

It’s important to know that not everyone who purchased a tuna product will qualify for compensation. The settlement is limited to consumers who purchased certain canned or packaged tuna products within a specific time period. 

 

Here are the requirements to see if you qualify:

  • Qualifying products: Cans or pouches of tuna smaller than 40 ounces for personal consumption (not for resale).
  • Qualifying period: You need to have purchased a tuna product between June 1, 2011, and July 1, 2015.
  • Qualifying states: Not every state benefits from the settlement. You must have been a resident between June 1, 2011, and July 1, 2015, in one of the following states:
    • Arizona, Arkansas, California, the District of Columbia, Florida, Guam, Hawaii, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, West Virginia and Wisconsin.

 

Eligible class members with an approved claim will receive an estimated $24.50 for every 200 cans purchased (roughly $0.12 per can). 

 

However, individual payment amounts vary on a number of factors, like:

  • Volume of products included in each claim
  • Number of valid claims
  • Total settlement administration cost
