FuboTV has agreed to pay $3.4 million to settle claims brought in a recent class action lawsuit filed. 

 

The streaming service stood accused of violating federal and state privacy laws by collecting and sharing users' personally identifiable information with third parties like Facebook and Google without proper consent.

The lawsuit against FuboTV centers on allegations that the streaming service violated the federal Video Privacy Protection Act (VPPA) by sharing subscribers' viewing habits and personal information with advertisers without permission.

 

Privacy and user data sharing allegations 

According to court documents, the company allegedly used sophisticated tracking technology to collect users' personally identifiable information.

 

FuboTV's privacy policy at the time claimed the company would only share non-personally identifiable information with third parties unless users provided consent. 

 

However, class members are saying that FuboTV shared detailed user data with major advertising platforms, including:

  • Viewing histories and specific videos watched.
  • Device information and usage patterns.
  • Precise geolocation data and GPS coordinates.
  • Account information linked to individual identities.

 

These alleged privacy violations also extend to the California Invasion of Privacy Act (CIPA) and California Civil Code § 1799.3, which provide additional protections for California residents' personal data.

 

Settlement details and agreement

The $3.4 million settlement fund represents FuboTV's agreement to resolve these privacy class action claims without admitting wrongdoing.

 

After deducting attorney fees, settlement administration costs, and service awards for class representatives, the remaining funds will be distributed equally among valid claimants.

 

Kroll Settlement Administration LLC serves as the settlement administrator, handling all claim processing and distribution of settlement payments. 

 

Who Qualifies for the FuboTV Class Action Settlement?

Settlement class members include all persons who had an account to use the Fubo platform or used the Fubo account of another person while residing in the United States or its territories on or before May 29, 2025. 

 

Eligible class members

This broad definition means you may qualify if:

  • You shared a FuboTV account with family members.
  • You used a friend's login credentials.
  • You had a free trial that converted to a paid subscription.
  • You canceled your account before the cutoff date.

 

Excluded parties include FuboTV Inc. and FuboTV Media Inc. employees, officers, directors, and legal representatives.

 

How to determine eligibility

Many eligible class members received email notifications in July 2025 containing a unique “Notice ID.” This identifier streamlines the claim submission process, though it's not required to file a claim.

 

Members who didn't receive a notice but believe they qualify can still potentially participate by providing the following information with their claim form:

  • Email addresses associated with their FuboTV account.
  • Approximate dates you used the streaming service
  • Confirmation that you resided in the US or its territories during use

FuboTV Settlement Payout Structure 

After deductions, each approved claimant will receive an equal share of the net settlement fund. 

 

While exact payment amounts depend on the number of claims filed, class action attorneys estimate payouts could range from modest to substantial amounts per claimant.

 

Payment calculation follows this model:

  • $3,400,000 total settlement fund
  • Minus attorney fees and expenses (up to $1,360,000)
  • Minus settlement administration costs
  • Minus service awards (up to $12,500 total)
  • Equals net settlement fund for distribution

 

Enhanced California Resident Payments

California residents who meet specific criteria may receive enhanced compensation or 1.1 times the standard payment amount.

 

This additional 10% recognizes the stronger privacy protections under California law, including CIPA and Civil Code § 1799.3.

 

To qualify for the enhanced payment, California claimants must certify they accessed FuboTV while physically in California during the class period.
