Who Qualifies and How Much Can You Claim?
Anyone who purchased Deep River brand potato chips in the United States at any point between February 2, 2017, and December 6, 2024, for personal or household use can file a claim. Here’s how the compensation works:
- With proof of purchase: If you submit a valid claim with proof of purchase for each claimed product, you may receive $5.00 for the first product and $0.50 for each additional product. There is no limitation to the number of products you can seek compensation for if you provide proof of purchase for each product.
- Without proof of purchase: If you submit a valid claim without proof of purchase, you may receive $5.00 for the first product and $0.50 for each additional product up to 10 additional products.

The class action lawsuit states that specific Deep Snacks potato chips were labeled with a “Non-GMO Ingredients” graphic, giving consumers the impression their products were certified as GMO-free by a third party.
